Privacy Policy
The Sydney Symphony Orchestra respects your privacy and is committed to protecting your personal information and complying with its obligations under the Privacy Act 1988 (Cth) (Privacy Act).
This Privacy Policy explains how we handle your personal information, and the ways in which you can contact us about the personal information that we hold about you.
Types of Personal information collected
Personal information we collect is information about you, such as your name, contact details and records of your dealings with us.
Collection
We collect personal information from our customers, members, donors, supporters, business contacts, and other individuals with whom we deal. We only collect personal information by lawful and fair means.
We will collect your personal information through our interactions with you, such as where you purchase a ticket to a performance or subscribe to season performances, where we communicate with you in person, by telephone, mail or email and SMS, or when you enter your personal information on our website. We also collect personal information about you from agencies who sell tickets to you on our behalf.
In some cases, where it would be unreasonable or impracticable to obtain your personal information directly from you, we may seek to obtain it from a publicly available source, or a third party.
Purposes for handling personal information
We collect, hold, use and disclose your personal information for the following purposes:
- to interact with you
- to carry out transactions with you, such as to process payments and donations received by you
- to assess your eligibility to access any of our programs
- to maintain our business records
- to seek donations or sponsorship
- to provide you with information about activities, events and products that may be of interest to you
- any purpose required or permitted by law
- any purpose disclosed to you and to which you have consented
- any purpose that you would otherwise reasonably expect, and
- otherwise to run our business.
Disclosure
We will not sell, share or rent any of your personal information to third parties, except as specified in this Privacy Policy, or for a purpose that you would reasonably expect, that is required or permitted by law, or for which you have provided consent.
We may disclose your personal information to third parties, such as:
- our service providers, including IT services, insurers, financial institutions, mailing houses, etc
- our related companies, member organisations and other business partners
- our professional advisers, including lawyers, accountants and auditors
- government, regulatory and law enforcement authorities, and
- your agents and representatives.
We hold most of our personal information on a secure database located in Sydney, New South Wales. Our database provider is an American Company. We may occasionally need to provide personal information to the Company in the United States of America however most of our database work is undertaken by the database company in New South Wales.
In the course of undertaking our business we may disclose your personal information to IT services, insurers, financial institutions mailing houses etc which may have their facilities located outside of Australia.
Security
We hold your personal information in both paper-based and electronic files. Electronic information is stored on secure servers that are protected in controlled facilities. In some cases, these facilities may be overseas. We seek to ensure that personal information that we hold is protected from misuse, interference and loss caused by unauthorized access, modification or disclosure. Our employees and agents are obliged to treat any personal information held by us confidentially.
Acurracy
We take reasonable steps to ensure that the personal information that we collect, hold and use is accurate, up-to-date and complete, and that the personal information that we disclose to third parties is also relevant. As such, we encourage you to contact us if you believe that any of the personal information that we hold about you is inaccurate, outdated, incomplete, irrelevant or misleading.
You may request that we correct such personal information by contacting us directly and providing the details.
We will respond to all requests to correct your personal information. We are not obliged to correct any of your personal information if we do not agree that it requires correction and we may refuse to do so. If we refuse, we will provide you with a written notice explaining the basis for our refusal.
Our website
Our website utilises "cookies", which are pieces of data that are stored on your hard drive containing details about your use of our website. Use of a cookie does not provide us with information about you that can be used to identify you, rather, they anonymously track usage of our website, so that we can enhance users' experience of our website. You may elect to reject cookies and still use our website, however in doing so, you may be unable to access certain pages.
We also use IP addresses to analyse trends, administer our website, track use movements on our website, and gather broad demographic data for aggregate use, which we may share with our partners and advertisers. We note that IP addresses are not linked to any information that could identify you.
Marketing
We may use the personal information that we hold about you, including your contact details, to provide you with information about activities, events and products that may be of interest to you, or to seek donations or support for our activities.
You may opt out of receiving all or certain types of marketing information from us at any time by contacting us directly on the details provided below or by using the opt out options provided in our communications, including the unsubscribe functions in our emails and SMS messages.
Access
Please contact our Privacy Officer on the details provided below if you wish to gain access to and check the personal information that we hold about you.
We will respond to all requests for access. On the rare occasions when we refuse access, we will provide you with a written notice stating our reasons for refusing access and the provisions of the Privacy Act on which we rely to refuse access.
We may seek to recover from you reasonable costs that we incur for providing you with access to any of the personal information that we hold about you.

If you have any questions, concerns or complaints about the way in which we have handled your personal information, or if you believe that we have not complied with our obligations under the Privacy Act, you may contact our Privacy Officer on the details provided below.

Changes to this Privacy Policy
We may make changes to this Privacy Policy at any time without notice to you. At any time, our current Privacy Policy is available on our website.

Social Media Policy
The Sydney Symphony Orchestra provides access to its social media channels, including via the Facebook, Twitter, Instagram and YouTube platforms (Sydney Symphony Orchestra Social Media), on the terms and conditions of this Sydney Symphony Orchestra Social Media Policy and terms of Use (the Policy). By accessing, viewing, participating in, contributing to or otherwise using Sydney Symphony Orchestra Social Media, or continuing to do so, you acknowledge, accept and agree to be legally bound by these terms and conditions as well as any terms and conditions of the third party operators of the social media platforms that you access.
In this Policy:
- headings are for convenience only and do not affect interpretation;
- mentioning anything after "includes", "including", "for example", "such as" or similar expressions does not limit what else might be included;
- if a word or phrase is defined, its other grammatical forms have a corresponding meaning;
- a reference to a "person" includes an individual, corporation, trust, partnership, unincorporated body or other entity, whether or not it comprises a separate legal entity;
- a reference to this Policy is this Policy as amended in accordance with the section headed "Variation of Policy" below.
This Policy is governed by the laws of New South Wales, Australia. In relation to it and related non-contractual matters each party irrevocably submits to the non-exclusive jurisdiction of courts with jurisdiction there.
Contributions
Sydney Symphony Orchestra does not accept responsibility or liability for any comments, images, content, media or any other materials posted, uploaded, communicated, provided or otherwise generated by you or any other user of Sydney Symphony Orchestra Social Media other than Sydney Symphony Orchestra (Contributions). Contributions are not representative of the opinions of Sydney Symphony Orchestra or any of its officers, agents or employees, nor does Sydney Symphony Orchestra confirm their accuracy.
We encourage the expression of opinions and free, frank and open discussion, but we also require users to act lawfully, responsibly and courteously.
Sydney Symphony Orchestra reserves the right to (where possible) delete or remove from Sydney Symphony Orchestra Social Media:
- Contributions that contain violent, obscene, lewd, vulgar, inappropriate, profane, hateful, derogatory, illegal, unlawful or racist materials or links, or incite such comment or behaviour;
- Contributions that contain materials or links that promote bigotry, racism, hatred or harm against any person or group of persons, or which promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
- Contributions that contain materials or links that threaten or defame any person or group of persons, or constitute the tort of injurious falsehood;
- Contributions that contain solicitations, advertisements (including for Sydney Symphony Orchestra tickets), or endorsements of any financial or commercial business or other endeavour;
- multiple successive off-topic Contributions by a single user;
- repetitive Contributions copied and pasted or duplicated by single or multiple users;
- Contributions that contain materials or links that are offensive, inaccurate, false, misleading or deceptive or otherwise unlawful;
- Contributions that infringe third party intellectual property rights;
- Contributions that contain any other inappropriate materials as determined by Sydney Symphony Orchestra in its absolute discretion;
- Contributions that contain links to any online location contains any of the above.
Users who do not comply with this Policy may also (where possible) be blocked or banned from Sydney Symphony Orchestra Social Media, or any part of it, in the Sydney Symphony Orchestra's absolute discretion.
Your Intellectual Property
Unless otherwise stated in relation to a particular Sydney Symphony Orchestra promotion or campaign, Sydney Symphony Orchestra does NOT claim ANY ownership rights in any Contributions. However, by making a Contribution, and in consideration for giving you the opportunity to make a Contribution, you grant Sydney Symphony Orchestra a non-exclusive, royalty-free, worldwide, perpetual, revocable (see below) licence to use, disclose, reproduce, copy, adapt, publish, perform, exhibit, communicate, display, rent, transmit, modify or otherwise exploit the Contribution, anywhere in the world, via any medium (including in any online media formats, through any social media channels, pages or accounts) and for any purpose (including without limited for archival, marketing, philanthropic and promotional purposes, such as promotion of Sydney Symphony Orchestra 's work in the arts generally or in relation to any specific performance) (the Licence).
In exercising its Licence rights, Sydney Symphony Orchestra will always act in accordance with the section headed "Privacy" below. Sydney Symphony Orchestra may sub-license its Licence rights to any other person. You can revoke the Licence at any time by sending an email to info@sydneysymphony.com with 'Social Media Contribution' in the subject heading and a copy of or specific reference to the Contribution attached, informing Sydney Symphony Orchestra that you no longer want Sydney Symphony Orchestra to use your Contribution.
If the Sydney Symphony Orchestra wishes to commercialise your Contribution, Sydney Symphony Orchestra may contact you to obtain a licence from you (or some other legal or beneficial right) in relation to the Contribution on terms different to the Licence terms.
Sydney Symphony Orchestra Intellectual Property
Nothing in this Policy, nor your use of Sydney Symphony Orchestra Social Media or your provision of a Contribution, assigns, licenses or otherwise confers on you any right, title or interest in or to the intellectual property of Sydney Symphony Orchestra or its licensors, such as logos, names, designs, trade marks and copyright materials (the Sydney Symphony Orchestra Content). Sydney Symphony Orchestra reserves all its rights and the rights of its licensors in the Sydney Symphony Orchestra Content. You must not exploit the Sydney Symphony Orchestra Content without the express written permission of the Sydney Symphony Orchestra.
Indemntiy
You indemnify Sydney Symphony Orchestra, its sub-licensees, its related bodies corporate and its successors, and any officer, agent and employee of any of them, against any claim (including third party claims), loss, damage, liability, cost and expense that may be incurred or sustained by any of them caused by or arising out of:
- your use or misuse of Sydney Symphony Orchestra Social Media;
- any failure by you to comply with this Policy; or
- your violation of any rights (including intellectual property rights) of a third party.
Variation of Policy
You agree that we may change this Policy from time to time. We will post a notice of the updated Policy at sydneysymphony.com, and they will take effect immediately or on a date which is nominated in the posting. Your ongoing use of Sydney Symphony Orchestra Social Media, whether by way of making Contributions or otherwise, after the changes take effect signifies your agreement to be bound by the updated Policy. You are responsible for checking the Policy regularly for changes.
Privacy
Any personal information acquired by the Sydney Symphony Orchestra from your use of any Sydney Symphony Orchestra Social Media will only be used in accordance with the Sydney Symphony Orchestra's Privacy Policy.
We note that the Sydney Symphony Orchestra Privacy Policy only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties on social media, different rules may apply to their use or disclosure of the personal information you disclose to them. We encourage you to exercise caution when disclosing your personal information, or the personal information of anybody else, publicly via social media.
Competitions
- Entries must be received within the timeframe specified.
- We will determine the winner(s) at our sole discretion.
- We will attempt to notify winner(s). If the Competition is run via a social media channel, we will attempt to notify the winner(s) by a message or comment on the social media channel concerned. If we are unable to reach the winner(s) within 7 days, we reserve the right to nominate a new winner.
- By entering a Competition, entrants:
- grant Sydney Symphony Orchestra permission to use their name(s) and hometown in winner announcement posts and/or notifications, as well as the unrestricted right to use (anywhere in the world and in any medium) any images submitted by entrants as part of the Competition; and
- agree that Sydney Symphony Orchestra will not be liable in any way whatsoever, in relation to the use of their name, social media profile and/or any images submitted as part of the Competition.
- Any prizes offered as part of a Competition will be as described by SSO. Prizes are not transferable and are not redeemable for cash. Taxes on any prizes are the responsibility of the winner. In the event that the prize specified in the Competition becomes unavailable for any reason, we will substitute a prize of similar value. Winners receive prizes entirely at their own risk.
- By entering a Competition, entrants acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with, any social media platform (including Facebook, Instagram, Twitter and/or Pinterest).
- Sydney Symphony Orchestra reserves the right to amend, vary, extend or discontinue a Competition at any stage, for any reason.
- Employees of, and contractors to, Sydney Symphony Orchestra are not eligible to enter Competitions or win prizes; they will be disqualified.
- Entry to a Competition is only open to Australian residents aged 18 years or over.
- To the full extent permitted by the law, Sydney Symphony Orchestra will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or indirect) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit.
- By entering a Competition, all entrants are deemed to have accepted these terms and conditions.
These terms and conditions apply to all competitions and promotions run by us, or on our behalf, including those undertaken via any social media channel (each a Competition). These terms do not apply, and we accept no responsibility for, competitions and promotions run by or on behalf of any party other than Sydney Symphony Orchestra (regardless of whether our products are part of the competition or promotion).
